Triceratops Contest
OFFICIAL CONTEST RULES
1. NO PURCHASE NECESSARY TO ENTER OR TO
WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL
FEDERAL, STATE, LOCAL ANDMUNICIPAL LAWS AND REGULATIONS APPLY.

2. Eligibility. Contest open to U.S. residents (excluding
Puerto Rico), 5 through 14 years old at the time of entry,
except employees of USA Weekend, Inc., Gannett Co., Inc.,
D.L. Blair, Inc., Smithsonian Institution, and each of their
respective affiliated companies, subsidiaries, and advertising
or promotional agencies, and the immediate family members
of, and any persons domiciled with, such employees.
3. Entry. The Name the Triceratops Contest (the "Contest")
will begin on February 16, 2001 and all entries must be received
by March 16, 2001 (the "Contest Period"). To enter, on a piece
of paper no larger than 8-1/2" x 11", type or print your complete
name, address, zip code, telephone number (with area code)
and date of birth. On one side only, type or print an original
essay of 100 words or less explaining why the name that you
are submitting is a good name for the triceratops. Entries
must be mailed to USA Weekend Name the Triceratops Contest,
P. O. Box 4020, Blair, NE 68009-4020. Limit one entry per
envelope. Overnight packages should be mailed to USA WEEKEND
Name the Smithsonian Triceratops Contest, D. L. Blair, Job
#1469, 1548 Front Street, Blair, NE 68008 (402-426-4701).
All entries must be received no later than on March 16, 2001.
You may enter the Contest as often as you like but only one
(1) prize per person. USA Weekend, Inc. ("Sponsor") will not
be responsible for incomplete, lost, late, postage-due, misdirected
or illegible entries. All entries become the property of Sponsor
and will not be returned.
4. Judging. A panel of judges from D. L. Blair, Inc.,
an independent judging organization will judge the entries
based on (1) originality of name (25%); (2) originality and
creativity of essay (25%), (3) writing skills (10%), and (4)
appropriateness of the name to the image of the Smithsonian
(40%). The judges will select fifty (50) finalists, whose
entries will be judged, based on the same criteria listed,
above by a panel of judges from the Smithsonian Institution
(the "Final Panel"). The Final Panel will select one (1) Grand
Prize Winner.
5. Prizes and Odds. One (1) Grand Prize Winner will
receive a trip for the Grand Prize Winner and up to three
(3) family members to Washington, D.C. on May 23, 2001 to
attend the Smithsonian triceratops naming ceremony. Grand
Prize includes round trip coach air fare for up to four people
from major airport nearest winner’s home, two (2) days/one
(1) night double occupancy, standard hotel accommodations,
and $400 in spending money. Costs of meals, ground transportation,
gratuities, transportation to and from airport and all other
expenses not specified as part of prize package are the sole
responsibility of winner. The trip package has a total approximate
retail value of $4,000, which may vary depending on location
of major airport nearest to winner's home. Odds of winning
depend on the number of eligible entries received.
6. Winner Notification and Acceptance. Winners will
be notified by telephone and/or U.S. Mail on or about May
11, 2001. Return of prize notification as undeliverable may
result in disqualification and an alternate winner may be
selected. Winners may waive their right to receive a prize.
Prizes are nonassignable and nontransferable. No substitutions
allowed, except that prizes and individual components of prize
packages are subject to availability and Sponsor reserves
the right to substitute prizes of equal or greater value.
Winners are solely responsible for reporting and payment of
any taxes on prizes. Winners may be required to complete an
affidavit of eligibility, and a liability and publicity release
(except where prohibited by law) which must be returned within
seven (7) days of date of postmark. Failure to sign and return
the affidavit or release within seven (7) days, or to comply
with any term or condition of these Official Rules, may, at
the sole discretion of Sponsor, result in a winner's disqualification,
the forfeiture of his or her interest in the prize, and the
award of prize to an alternate winner. Persons traveling as
guest of the Grand Prize Winner must also sign any affidavit
or release that Sponsor may require. Prizes won by minors
will be awarded to parent or legal guardian who must sign
any affidavit or release required by Sponsor. Except where
prohibited, participation in the contest constitutes entrant's
consent to the publication of his or her name and image in
any media for any commercial or promotional purpose, without
limitation or further compensation. For prize winners list
(available after May 15, 2001), send a self-addressed, stamped
(#10) envelope to USA Weekend Name the Triceratops Contest
Winner, 1000 Wilson Boulevard, 17th Floor, Arlington, VA 22229,
to be received by 7/13/01.
7. Participation. By participating, entrants agree
to be bound by these Official Contest Rules and the decisions
of the judges. Sponsor reserves the right to disqualify persons
found tampering with or otherwise abusing any aspect of this
Contest as solely determined by Sponsor. In the event the
Contest is compromised by tampering or other causes beyond
the reasonable control of Sponsor which corrupts or impairs
the administration, security, fairness or proper operation
of the Contest, Sponsor reserves the right in its sole discretion
to suspend, modify or terminate the Contest. Should the Contest
be terminated prior to the stated expiration date, Sponsor
reserves the right to award prizes based on the entries received
before the termination date.
8. Limitations of Liability. By entering the Contest,
entrant affirms that his or her entry, including the essay
the entrant is submitting, is original, and that Sponsor's
use of this entry will not violate any rights of any other
person or entity, including, without limitation, any copyright
rights of any person. By entering the Contest, entrant further
agrees that (1) any and all disputes, claims, and causes of
action arising out of or in connection with the Contest, or
any prizes awarded, shall be resolved individually without
resort to any form of class action; (2) any claims, judgments
and awards shall be limited to actual out-of-pocket costs
incurred, including costs associated with entering the Contest,
but in no event attorney's fees; and (3) under no circumstances
will any entrant be permitted to obtain any award for, and
entrant hereby waives all rights to claim, punitive, incidental
or consequential damages and any and all rights to have damages
multiplied or otherwise increased and any other damages, other
than damages for actual out- of-pocket expenses.
9. Construction. All issues and questions concerning
the construction, validity, interpretation and enforceability
of these Official Contest Rules, or the rights and obligations
of any contestant and Sponsor, shall be governed by, and construed
in accordance with the laws of the Commonwealth of Virginia,
without giving effect to any choice of law or conflict of
law rules or provisions (whether of Virginia, or any other
jurisdiction) that would cause the application of the laws
of any jurisdiction other than Virginia. The invalidity or
unenforceability of any provision of these rules shall not
affect the validity or enforceability of any other provision.
In the event that any such provision is determined to be invalid
or otherwise unenforceable, these rules shall be construed
in accordance with their terms as if the invalid or unenforceable
provision was not contained therein.
10. General Release. By entering the Contest, contestants
release USA Weekend, Inc., Gannett Co., Inc., Smithsonian
Institution, any other promotional sponsors, and each of their
respective affiliated companies, directors, officers, employees,
representatives, partners and agents from any liability whatsoever
for any claims, costs, injuries, losses or damages of any
kind arising out of or in connection with the Contest or with
the acceptance, possession or use of any prize (including,
without limitation, claims, costs, injuries, losses or damages
related to personal injuries, death, damage to, loss or destruction
of property, rights of publicity or privacy, defamation or
portrayal in a false light).
11. Sponsor. The Name the Smithsonian Triceratops Contest
is sponsored by USA Weekend, Inc., whose decisions regarding
the selection of winners and all other aspects of the Contest
shall be final and binding in all respects. Sponsor will not
be responsible for typographical, printing or other inadvertent
errors in these Official Contest Rules or in other materials
