OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
1. HOW TO ENTER: The USA WEEKEND-John Lennon Songwriting Contest for Teens (the "Contest") begins at 12:01 a.m. (E.S.T.) on 10/10/03 and ends at 11:59 p.m. (E.S.T.) on 2/13/04. (For newspapers with their own contests, deadlines may be different.) Submit your original song lyrics in one of two ways: (1) Enter online by visiting the official Contest registration page at usaweekend.com and completing all of the required information and following all instructions. Submit your entry by clicking on the "SEND" button. Online entries must be received by 11:59 p.m. (E.S.T.) on 2/13/04. (For newspapers with their own contests, deadlines may be different.) (2) You may also enter by typing or printing your complete name, grade, address, zip code, and home telephone number (including area code), and the name, address and telephone number of your high school on a piece of paper no larger than 8 1/2" x 11." On A SEPARATE SHEET OF PAPER, type (double-spaced) or hand print your original song lyrics (maximum 125 words). Song lyrics must appear on one side of the paper only and must relate to the theme of this year's contest, "American Dreams." Mail your completed entry in a hand-addressed #10 envelope, with first class postage affixed, to: USA WEEKEND-John Lennon Songwriting Contest for Teens, P.O. Box 8521, Prospect Heights, IL 60070. All mail-in entries must be postmarked by 2/13/04 and received by 2/20/04.(For newspapers with their own contests, deadlines may be different.) Entries must be the original work of the entrant, written in English, and must not exceed a total of 125 words in length (including the song title). All entries, including the copy of entrants' song lyrics, become property of Sponsor, and none will be returned. Only one (1) entry per person. Illegible entries are void.
2. ELIGIBILITY: Open only to U.S. residents (excluding Puerto Rico) who are 13 years of age or older at the time of entry and are high school students (grades 7-12) enrolled full-time in accredited public, private, parochial or home schools. Employees of USA WEEKEND ("Sponsor"), Gannett Satellite Information Network, Inc., National Broadcasting Company, Inc. ("NBC"), The John Lennon Songwriting Contest Educational Tour Bus, and each of their respective parent, affiliate, and subsidiary companies, and advertising or promotional agencies, and other agents, and the immediate family members of, and any persons domiciled with, such employees, are not eligible. For purposes of this Contest, the term "immediate family members" include spouses, grandparents, siblings, children, and grandchildren.
3. JUDGING AND WINNER NOTIFICATION: Eligible entries will be judged in a preliminarily round and 10 Finalists in will be selected on or about April 16, 2004. The preliminary round will be judged by Promotion Activators, Inc., an independent judging organization. Finalists will then be judged in a second round and one (1) Grand Prize Winner will be selected on or about April 30, 2004. The second round will be judged by a panel of celebrity judges chosen by USA WEEKEND. All judging will be based on the following criteria: 30% originality and creativity; 30% songwriting ability (as exemplified in the lyrics submitted); 20% appropriateness of song lyrics for recording; 20% appropriateness of song lyrics for the "American Dreams" theme. In the event of a tie, tied entries will be re-judged in accordance with criteria listed above. Decisions of judges are final and binding in all respects. Grand Prize Winner will be notified by phone no later than June 30, 2004. Sponsor's inability to reach Grand Prize Winner at the telephone number listed on entry form may result in disqualification, and an alternate winner may be selected. The Grand Prize Winner and his/her parent or legal guardian will be required to complete an affidavit of eligibility, certifying that the entrant's submission is entrant's original work, that entrant owns the right to the work, that the submission has not previously won a prize in a national contest, does not copy any other work in whole or in part or otherwise infringe on any third party rights, and has not previously been published in a national publication, and that entrant has complied with the Official Rules of the Contest. The Grand Prize Winner and his/her parent or legal guardian will also be required to complete a Release of Liability and Publicity Release/Prize Acceptance Form (except where prohibited by law). Affidavits and release forms must be returned within seven (7) days of date of postmark. Failure to sign and return the affidavit or release within seven (7) days, or to comply with any term or condition of these Official Rules, may result in Winner's disqualification and the selection of an alternate Winner. For name of winner, send a self-addressed, stamped #10 envelope to: USA WEEKEND-John Lennon Songwriting Contest for Teens, P.O. Box 8521, Prospect Heights, Ills. 60070 by July 1, 2004.
4. PRIZES: Subject to eligibility and compliance with these Official Rules, the Grand Prize Winner will receive: (i) a trip for two (2) to Los Angeles, CA (ARV: $2,000); (ii) a walk-on role in an episode of the NBC Series "American Dreams"; (iii) winning lyrics published in USA WEEKEND; (iv) a $1,000 U.S. Savings Bond; (v) a Yamaha AW 16G 16-track hard disk recorder/CD burner courtesy of Yamaha (ARV: $1,295); and (vi) 100 Maxell CD-R recordable CDs valued at $177, courtesy of Maxell. Total ARV of Grand Prize package is $4,863, which may vary depending on location of major airport nearest to winner's home. Actual retail value depends on the city/date/time of departure and return. In addition, the Winner's school will receive $500 from themusicedge.com and a copy of the interactive biography Lennon Legend: An Illustrated Life of John Lennon, by James Henke. Grand Prize package includes round trip coach airfare for two (2) from major airport nearest winner's home to Los Angeles, CA and 3 days/2 nights standard room/ double occupancy hotel accommodations at a hotel of Sponsor's choosing. Costs of meals, ground transportation, gratuities, transportation to and from airport and all other expenses not specified as part of prize package are the sole responsibility of winner. Trip must be taken on dates specified by Sponsor, in Sponsor's sole discretion. Other restrictions may apply. Winner and guest must travel on the same itinerary. If Winner is a minor, Grand Prize package will be awarded to Winner's parent or legal guardian, who must accompany the Winner. All details of the walk-on role will be determined by Sponsor, in Sponsor's sole discretion, subject to availability and production exigencies. Winner must be available during the production schedule of the NBC Series "American Dreams" (the "Series") and on the dates selected by Sponsors. If the Series is not in production, if the Series is cancelled prior to Grand Prize Winner's appearance, or in the event that any prize component is not available for any reason, then remaining elements of prize shall constitute full satisfaction of Sponsor's prize obligation to Winner and no additional compensation will be awarded. No substitution, transfer, or cash equivalent for prize (or prize components) allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes (or prize components) of equal or greater value. Winner, or if Winner is a minor then Winner's parent or legal guardian, will be required to sign NBC's Walk-On Release Form prior to appearing on the Series. The nature of the walk-on role in which the Winner will appear will be made by the Series' producers in their sole and exclusive discretion. Series producers are not obligated to have the Winner appear on the Series or to broadcast or otherwise use or exploit the Series or any part thereof. Grand Prize Winner and his/her parent or legal guardian must execute an affidavit of eligibility and a liability and publicity release (except where prohibited) prior to ticketing and must possess required travel documents (i.e. valid Government-issued photo I.D.) prior to departure. Grand Prize package consists of only those items specifically listed above. NBC may (but is not obligated to), in its sole discretion, use Winner's song lyrics to produce and record a song to be used in a future "American Dreams" episode or in any other fashion.
5. GENERAL RULES: Winner may waive his/her right to receive prizes. Prizes are nonassignable and nontransferable. All federal, state and local taxes are the sole responsibility of winner. Sponsor will not be responsible for lost, late, incomplete, postage-due, illegible, mutilated, or misdirected entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with the sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such account by the Internet access provider, online service provider, or other organization responsible for assigning such accounts. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest, as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor, which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. Except where prohibited, participation in the Contest constitutes entrant's (and if a minor, his/her parent's or legal guardian's) consent to the publication of entrant's name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges and to release, indemnify and hold harmless USA WEEKEND, Gannett Satellite Information Network, Inc., National Broadcasting Company, Inc., The John Lennon Songwriting Contest Educational Tour Bus, and any other promotional sponsors, each of their respective parent, affiliate, and subsidiary companies, and all of their directors, officers, employees, representatives, partners and agents, from any liability whatsoever for any claims, demands, actions, costs, injuries, losses, liabilities, expenses (including reasonable attorneys' fees) or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize or travel to or from any prize related activity (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant or Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Virginia, without giving effect to any choice of law or conflict of law rules or provisions (whether of Virginia or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Virginia.
6. COPYRIGHT RIGHTS: By completing and submitting an entry form, each entrant agrees that if selected as Grand Prize Winner he or she will grant to Sponsor a perpetual, royalty-free, irrevocable right and license to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify and otherwise exploit the lyrics (as a whole or in part), in its sole discretion, including the right to incorporate the lyrics into or use the lyrics in connection with other works, for any purpose and in any manner or media now known or later devised throughout the world and to license others (including, without limitation, NBC and The John Lennon Songwriting Contest Educational Tour Bus) to do so, all without further compensation. The above license will be exclusive for a period of five (5) years only as to use of the lyrics on or in connection with soundtrack albums related to a television program, such that the Grand Prize Winner will have no right to perform, display or otherwise use his or her winning entry on or in connection with a soundtrack album related to a television program other than the soundtrack album promoting the NBC Series "American Dreams" during this five (5) year exclusive time period. Other than this limited grant of exclusivity, the license granted to Sponsor will be non-exclusive. Each entrant agrees to waive his or her rights to attribution, integrity, or any other moral right in connection with the use of the lyrics by Sponsor or Sponsor's licensees and agrees to allow use of his or her name and city in publicity or advertising in connection with the use of the lyrics by Sponsor or Sponsor's licensees without compensation. Each entrant further agrees that if his/her lyrics are selected by Sponsor as the winning lyrics, he/she or his/her parent or guardian will sign any additional license or release that Sponsor may require. Sponsor may review all lyrics but does not otherwise assume responsibility for the content of the text of the lyrics. Neither NBC nor Sponsor shall have any obligation to use, copy, publish, display or otherwise exploit the lyrics, either during the period of exclusivity or thereafter, nor shall they be obligated to prevent, or have any liability for, any unauthorized copying, publishing, display or other exploitation of the lyrics.
7. SPONSOR: The USA WEEKEND-John Lennon Songwriting Contest for Teens is sponsored by USA WEEKEND, whose decisions regarding the selection of winner and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
